Ewha Law School Student Team Wins Speaker of the National Assembly Award at the 12th Yellow Envelope Act Moot Court Comp N

Lee Ji Hyun, Choi Yun Min, and Kim Su Hyang, members of the 18th class of Ewha Law School, under the guidance of Professor Park Gwi Cheon, received the Speaker of the National Assembly Award, the highest honor at the 12th Yellow Envelope Act Moot Court Competition.
“The Yellow Envelope Act Moot Court Competition”, the only labor law moot court competition in Korea, was established to increase aspiring legal professionals’ interest in and expertise in labor law. This year, a record-high 96 students from law schools across the country participated, forming a total of 32 teams and engaging in fierce competition in the preliminary round. Following a written evaluation, eight teams advanced to the final round. At the final round, held at Gwangbokgwan at Yonsei University on Saturday, August 22, each team presented arguments representing both the plaintiff and defendant.
This year’s competition was particularly significant as it was the first moot court competition to address relevant legal principles in depth following the implementation of the revised Trade Union and Labor Relations Adjustment Act, commonly known as the “Yellow Envelope Act.” With relevant precedents yet to accumulate, aspiring legal professionals directly interpreted newly emerging labor law issues and developed legal arguments based on the intent behind the amended law.
Lee Ji Hyun, Choi Yun Min, and Kim Su Hyang of Ewha Law School received the highest honor, the Speaker of the National Assembly Award, in recognition of their thorough analysis of new legal issues, logical written arguments, and persuasive oral advocacy. In the final round, the Ewha team argued that the revised Trade Union Act should be interpreted in a way that substantively guarantees the three fundamental labor rights of subcontracted workers in principal contractor–subcontractor relationships, based on the intent of the amended law. They also argued that, even in industrial settings where hazardous materials are handled or continuous processes are carried out, workplace safety, facility protection, and workers’ right to collective action should be balanced. In addition, through the issue of replacement operations using physical AI robots, the team presented a legal interpretation of how existing labor law should be applied to changes in the labor environment resulting from technological advances.
Lee Ji Hyun mentioned, “It was meaningful to have the opportunity to examine current issues such as bargaining between subcontractors and principal contractors and changes in labor brought about by AI robots. In particular, as this was the first year since the revised labor law came into effect, it was also very meaningful to have the opportunity to thoroughly consider the intent behind the amendments to the Yellow Envelope Act.” She added, “I will continue studying labor law with gratitude, keeping in mind what I learned from this competition throughout my time at law school.”
This award demonstrates the strong practical legal capabilities of Ewha Law School students in analyzing new legal issues and seeking solutions amid rapidly changing industrial and labor environments.
